Can i claim leaving indemnity or ESB?

Hi All (mr. XTang especially),


I'm expat working in a subsidiary company of a parent company (two different legal entities). In a recent organization structure, we are asked to sign a new contract with the parent company. It means I will be moved to the parent company, no longer working in subsidiary, but still in Bahrain.

Question:

Can I claim my leaving indemnity or ESB (end of service benefits) of the subsidiary company?

TBH, I'm afraid if I sign the new contract and move to parent company, probably the term and condition including my previous rights no longer apply.

Please advice me on this matter. thanks.

Please read your new contract before you sign it, also speak to your HR regarding this and see what they have to say.

But i want to know, legally, we should be able to claim (encash) the ESB first from the old company (subsidiary) right?

Because again, old company (subsidiary) and new company (parent) are two separate legal entities.


Unless the new contract states and ensure the continuation of service leads to ESB guarantee, which i will pay attention.

Legally yes since you're signing a contract with a new company altogether.
